| Description of Services |
| This agreement allows users to access FluidPowerTools.com Component Data for use in VEST’s schematic drawing software, HyDraw® CAD. It provides mobile and industrial hydraulic model data for manufacturers like Parker, Bosch Rexroth, Eaton, SUN and several others. This data can be downloaded into a component in a HyDraw CAD drawing and merged with other data like price, not available through the service. The data may not be saved into a local database. For a listing of current OEM data available, please refer the Manufacturers tab on FluidPowerTools.com. |
| Registration Data |
| Registration is processed by VEST, Inc. as part of the registration process, VEST Inc. will collect limited information about the Subscriber. All data provided by or on behalf of the Subscriber must be current, complete, and accurate. |
| Availability of Service |
| It is understood that while VEST will make every effort to ensure that the service is available at all times, there may be times when the service is unavailable momentarily. The user will not be entitled to refund of subscription service in this case. |
| Accuracy of Component Data |
| VEST will make every effort to ensure that the component data is accurate and up to date. The Subscriber will be solely responsible for the usage of this data. The Subscriber will hold VEST, Inc. and the Manufacturer harmless for any and all liability that may arise from the use of this data. |
| Completeness of Data |
| VEST does not guarantee that all the model data of the available product lines for a particular Manufacturer will be available through FluidPowerTools.com. |
| Platforms Supported |
| FluidPowerTools.com supports Windows 10 operating system and the latest release of HyDraw CAD. Maintain the latest version of HyDraw to guarantee access to FluidPowerTools.com data within HyDraw. |
| Subscription Charges |
| Subscription charges are payable in advance. For current subscription rates, please contact VEST, Inc. |

| Subscription restrictions |
| The subscription fee, entitles only the Subscriber the rights to use the service. This subscription cannot be shared with others. Violation will result in cancellation of subscription privileges. |
| Disclaimer of Warranties |
| Subscriber hereby acknowledges and agrees that the services are provided by VEST, Inc . on an ‘As Is’ basis, and the Subscriber’s access and use of the service is at it’s sole risk. FluidPowerTools.com and VEST, Inc. expressly disclaim all warranties of any kind, whether express or implied, including any damages that may result from the use this service. VEST Inc. makes no warranty that the services will meet the requirements of the Subscriber, or that the services will be uninterrupted, or error-free, nor does VEST Inc. make any warranty as to the results that may be obtained through the use of the services. Subscriber understands and agrees that any data downloaded through the use of the service is done at the sole risk of the Subscriber and the Subscriber will be solely responsible for any damage resulting from it. |
| Limitation on Liability |
In no event will VEST, Inc. nor the manufacturers be liable for any direct or indirect damages related to this Agreement.
